Frequently Asked Questions
What is legal aid?
Legal aid is a subsidy paid by the government to a lawyer, to pay for some legal services. In some cases you will need to pay it back to the government. Do I need to be a citizen to qualify for legal aid?
No. Anyone in New Zealand that is subject to our law is entitled to legal aid, if they meet the eligibility criteria. What legal issues can I get it for?
Legal aid is available for most matters before the Criminal, Civil or Family Courts. For a complete list, click here. |
What are the 'eligibility criteria'?
CRIMINAL: If you can’t afford your own lawyer and either you’re charged with a criminal offence and could face a prison term of 6 months or more or the interests of justice require that you be granted legal aid. FAMILY: Your income, assets and the merits of the legal case. Legal aid is not normally available for problems that don’t go to court (such as drawing up a will), or for divorce proceedings. CIVIL: Any arrears from a previous legal aid debt, your income, assets and the merits of the legal case. |
